The loan and mortgage documents in favour of Perpetual were found to be forged, with David El-Bayeh not having executed or authorised them. The registered mortgage is effective only to the extent it secures monies for which David El-Bayeh is liable in restitution—namely, the sum advanced to discharge a Westpac mortgage that was itself a result of prior forgery. Perpetual may recover this amount from David El-Bayeh, but not the further funds paid into an account that David El-Bayeh did not benefit from. Perpetual is entitled to judgment against Youssef El-Bayeh as the fraudster. No liability was found against CTC or Mr Saadie as there was insufficient proof of breach of their obligations...
