The High Court does not have jurisdiction in a common informer action under s 3 of the Common Informers (Parliamentary Disqualifications) Act 1975 (Cth) to determine whether a person is constitutionally incapable of sitting as a member of the House of Representatives; that question can only be determined by the House in which the question arises, or as otherwise provided (e.g., by reference to the Court of Disputed Returns pursuant to the Commonwealth Electoral Act 1918 (Cth)).
