Schiff v Nine Network Australia Pty Ltd [2022] FCA 658
Although the ordinary course is to try all issues together, the large number of imputations pleaded and denied, the assumption that the denials were seriously maintained and had reasonable prospects, the obvious capacity for substantial saving in time and cost if the denials were upheld, the real capacity to simplify any ultimate hearing, and the possibility of assisting further resolution justified ordering that the proposed questions be determined separately from and in advance of all other questions.
