Legal Issues
- 1 Whether the employment contract was unfair in not providing for redundancy and severance pay on termination of employment
- 2 If so, what was a fair redundancy severance payment?
- 3 Whether the contract was unfair in the amount of notice given to the appellant on termination of employment
Ratio Decidendi
The contract of employment was unfair in failing to provide appropriate severance pay where the respondent did not secure ongoing comparable employment for the appellant. The evidence established that no actual offer of ongoing employment with Elders was made; only a franchise was offered, which is not comparable to employment. The Full Bench accepted the appellant's uncontested evidence and found error in the first instance rejection of redundancy pay. The appellant is entitled to 20 weeks' severance pay, but no further notice is awarded due to mitigation.
Court Disposition
Appeal upheld in part (for redundancy pay), leave to appeal granted, first instance decision on redundancy pay set aside; but the appeal fails on notice period.
Orders
- Leave to appeal is granted.
