Hartog v Pittwater Council [2006] NSWLEC 643
The appeal was upheld because, although the proposed elevated plunge pool would create visual privacy and acoustic issues for 26 Pacific Road as designed, those impacts could be satisfactorily addressed by lowering the pool by 1 metre, altering the wet edge treatment to a quieter spill way design, and imposing deferred commencement and other conditions requiring proper amended drawings. The site coverage increase was not a reason for refusal because the small pool occupied only about 1% of the site in a courtyard area, had no significant bulk impact, and did not displace significant vegetation.
