Phillips v Commonwealth [1964] HCA 22
The Commonwealth bore and discharged the onus of proving that the appellant was no longer totally incapacitated, a finding conclusively supported by the medical board certificate and not challengeable. Any claim for compensation on the different basis of partial incapacity with diminished earning capacity under par. 1 (c) was in substance a new claim on which the appellant bore the onus. The County Court Judge therefore made no error of law, and the evidence did not compel the finding for which the appellant contended.
