Procedural Posture

Interlocutory Application / Application for Leave to Amend Statement of Claim

  1. 1 ['Whether the proposed amended statement of claim adequately pleads a cause of action for misleading and deceptive conduct based on representations as to future matters under s 51A of the Trade Practices Act 1974 (Cth)' 'Whether it is sufficient to plead that a representation was made and proved to be false in cases involving s 51A' 'Whether representations pleaded as collateral warranties are capable of having promissory effect and should proceed to trial' 'Whether the statement of claim should be struck out as embarrassing or failing to disclose a cause of action']

Ratio Decidendi

The applicants are entitled to plead a cause of action based on s 51A of the Trade Practices Act 1974 (Cth) by making clear reliance on that section; it is not necessary for applicants to plead absence of reasonable grounds for a representation as to a future matter, as s 51A casts the evidentiary burden on the respondent. The proposed amended pleading sufficiently raises the issues for trial and is not to be struck out. Claims based on collateral warranties are not hopeless at this stage and may proceed to trial for determination based on the facts.
