Provincial Planning Pty Ltd v Warringah Council [2004] NSWLEC 249
The proposed buildings were sited and designed, and landscaping was used, so that the development related favourably to the pattern, scale and landscaped character of the street and surrounding development. The buildings were of an acceptable scale, had sufficient setbacks and landscaping, did not cause unacceptable privacy or overshadowing impacts, and the amended basement car park did not prevent a favourable relationship with the locality. The proposal therefore satisfied the density exemption and was consistent with the Desired Future Character of the area.
