Clark v Public Trustee [2006] NSWSC 817

Clark v Public Trustee [2006] NSWSC 817

Neither Plaintiff has established that, as a result of the will, they have been left without adequate provision for their maintenance. Both are financially secure, received prior benefit from the Deceased and from other inheritances, and have no demonstrated present need. Even if their claims had succeeded on merit, the substantial competing claim of the widow, who contributed significantly to the estate, would have extinguished any entitlement.
