The appeal failed because the services for which Qantas' 1984 mark is registered ('advertising, marketing and merchandising') were not 'closely related services' to the respondent's goods for the purpose of s 44(1) of the Trade Marks Act 1995 (Cth) and because the opposed mark was not deceptively similar to Qantas' marks. Further, while Qantas' marks had a strong reputation in connection with its airline services, the use of the opposed mark in relation to clothing and similar goods was not likely to deceive or cause confusion under s 60.
