Repatriation Commission v Cedric Newson [2008] FCA 401
The Tribunal erred in law by failing to ensure that, under clause 4 of Statement of Principles No 82 of 2001, the requirements of clauses 5(j) and 5(k) for entitlement were related to relevant service. The clinical onset period for osteoarthrosis should have been measured from the end of the activity during or directly following relevant service, not by including post-service employment as satisfying the activity, and thus Mr Newson failed to meet the necessary requirements for his conditions to be deemed war-caused.
