The Tribunal erred in reading down s 7A(1A). On the proper construction of the Veterans' Entitlements Act 1986 (Cth), s 7A(1)(a)(iii) was expressly subject to s 7A(1A), and service in the area described in item 3 of Schedule 2 was qualifying service only if the person had been awarded or had become eligible to be awarded a British General Service Medal with the Malaya Clasp. Because the respondent was not awarded and was not eligible to be awarded that medal, he did not render qualifying service within s 7A.
