Procedural Posture

Motor Vehicle Accident Damages Action Under the Motor Accidents Act / Assessment of Damages Only

  1. 1 ["What damages should be assessed for the plaintiff's injuries arising from the motor vehicle accident on 4 July 1988." "Whether the plaintiff's claimed out of pocket expenses, future prosthesis expenses, future treatment expenses, past economic loss, future economic loss and non-economic loss should be allowed." 'Whether the plaintiff had actual brain damage or instead genuine continuing symptoms arising from physical and emotional consequences of the accident.' 'Whether the plaintiff retained residual earning capacity for the purpose of assessing future economic loss.']

Ratio Decidendi

The plaintiff's symptoms and disabilities were genuine and continuing, including total loss of the left eye, monocular vision with significant disturbances, facial injury, pain symptoms and serious emotional consequences. Although frank brain damage was not proved, the accident left him effectively unfit for his Telstra work and largely sheltered until he ceased attending work. The claimed heads of damage were substantially supported, with reductions for the chance only of reconstructive cheek surgery and for vicissitudes and residual earning capacity in future economic loss. Damages were assessed at $744,896.

Court Disposition

Judgment entered for the plaintiff in the amount of $744,896.
