The plaintiff failed to satisfy the Court that Mrs Ludewig had testamentary capacity when she signed the will dated 12 July 2006. The Court accepted the main thrust of Dr Rosenfeld's evidence, supported by nursing notes and the defendants' evidence, that Mrs Ludewig's dementia, forgetfulness, lack of insight, inability to hold a complex conversation and cognitive impairment meant the Court could not be satisfied she could weigh the claims on her estate. The 2006 will was therefore not admitted to probate and the 1992 will was granted probate.
