Procedural Posture

Anti Discrimination Complaint / Hearing and Final Decision

  1. 1 ['Whether the respondent is liable for sex discrimination against the applicant under the Anti Discrimination Act 1977' 'Whether the respondent is liable for victimisation of the applicant under the Anti Discrimination Act 1977' 'Whether alleged conduct amounted to unlawful discrimination' 'Whether the respondent is vicariously liable for employee conduct']

Ratio Decidendi

Although the applicant experienced conduct that was discriminatory within the meaning of s 24(1)(a) of the Anti Discrimination Act 1977 during a limited period, the employer responded appropriately after being notified, the conduct did not continue, and so the discrimination was not unlawful under s 25(2)(a); further, post-complaint workplace conduct was not established as discriminatory or causally linked to the making of the initial complaint, so claims of victimisation also failed.

Court Disposition

Both the claim of sex discrimination and the claim of victimisation have not been substantiated and are dismissed. No order as to costs.
