R v Staples [2001] NSWSC 990

R v Staples [2001] NSWSC 990

The Court re-determined the life sentence because, although the murder was appalling, extremely grave and close to a most serious case, it did not fall within the worst case category requiring life imprisonment. Taking account of the provocative circumstances, the applicant's prison conduct, established rehabilitation process, the totality of the criminality including the manslaughter of his pregnant wife, and the need to avoid preventative detention based only on personality traits, the Court held that a fixed sentence with a lengthy non-parole period and strict parole supervision could adequately reflect punishment, deterrence, retribution, totality and community protection.
