R v Achurch [2000] NSWCCA 537

The disparity between the applicant's sentence and that of a similarly involved co-offender, Hassarati, could not be justified on objective or subjective grounds. Insufficient weight was given to parity principles, and the applicant's greater involvement did not warrant a sentence so much greater than Hassarati's. The applicant was entitled to be sentenced relative to the leniency given to the most comparable co-offender, and should be re-sentenced to terms reflecting this relativity.
