The mortgagor was not in a special position of disadvantage, the mortgage terms (including clause 8) were not unjust, and the Consumer Credit Code did not apply because the loan was for business purposes and valid declarations were made. The finance broker acted as agent for the mortgagor. The accountant's certificate sufficed to establish loan serviceability.
