The applicant failed to provide an adequate explanation for delay and, crucially, had no reasonable prospect of succeeding on appeal. The medical evidence on record did not support the claim that the applicant could not comply with the employer's requirements due to his disability, and there was no evidence of the employer imposing the alleged requirements as conditions of employment.
