Egg Marketing Board v Bonnie Doone Trading Co (NSW) Pty Ltd [1962] HCA 3
The delivery of the eggs by Queensland producers to the respondent was an intra-State transaction, and the respondent's plan of carrying eggs from Queensland to a shed at Tweed Heads and back for resale in Queensland was not in truth inter-State trade. The crossing of the border did not alter the domestic character of the trade in the eggs. Because the eggs had been removed and carried contrary to Queensland law and without any protected inter-State disposition, the seizure was valid and did not impair freedom of trade, commerce or intercourse among the States.
