Procedural Posture

Unfair Dismissal Application (industrial Relations) / Interlocutory Decision on Extension of Time to File Application

  1. 1 Whether the applicant established a sufficient reason for filing his unfair dismissal claim outside the statutory 21-day period under s85(3) of the Industrial Relations Act 1996
  2. 2 Whether hardship would arise for the applicant or employer if the Commission exercised its discretion to accept the out of time application
  3. 3 Whether the conduct of the employer contributed to the delay in filing

Ratio Decidendi

The applicant was informed by the Union well before expiry of the statutory period that it would not pursue his unfair dismissal claim, and was advised to seek independent advice or file himself. Despite this, the applicant delayed taking action for a significant period without sufficient explanation, and failed to demonstrate that the delay was caused by factors outside his control or that any hardship or employer conduct justified granting an extension. Further, the applicant’s substantive case lacked reasonable prospects of success. Accordingly, the Commission declined to exercise its discretion to accept the application out of time.

Court Disposition

Application dismissed.

Orders

  • The applicant's unfair dismissal application is dismissed due to failure to establish sufficient reason for the delay in filing out of time.
