The defendant's motion to transfer failed because the substantive claims for declaratory relief and specific delivery remained on foot and, crucially, there was no evidence of the value of the 1997 Nissan Pulsar to establish that the proceedings were within the Local Court's jurisdiction. The Supreme Court therefore was not satisfied, as required by Civil Procedure Act 2005 s 146(1)(a), that the proceedings could properly have been commenced in the Local Court.
