The Superannuation Complaints Tribunal erred in its peremptory dismissal of the applicant's complaint because it did not properly address whether the facts, or facts on further inquiry, could establish that she had an interdependency relationship with the deceased and met the definition of dependant. The decision was therefore set aside and the complaint remitted to the Tribunal to be dealt with according to law.
