Ratio Decidendi

The respondent's causes of action in both negligence and under the Fair Trading Act accrued when, by reason of the knee surgeries in November 2007, the loss of earning capacity and potentially recoverable compensation became actual and measurable, and the inability to pursue further claims became apparent. As proceedings were first commenced nearly seven years later, the claims were statute-barred by the operation of s 63 of the Limitation Act 1969 (NSW). Accordingly, summary dismissal was warranted.
