Appeal / Post Appeal Consequential Orders

  1. 1 Whether interest on judgment monies repaid should be at the post-judgment rate or pre-judgment rate
  2. 2 Whether orders should be made for interest on costs incurred at first instance and on appeal after final orders

Ratio Decidendi

Orders for interest on costs recoverable by Secure Parking Pty Ltd should be made at the pre-judgment interest rate of 4% above the RBA cash rate (increasing to 6% above from 2017) to fairly compensate for being kept out of money. Indemnity costs from 20 December 2014 were warranted due to rejection of a Calderbank offer. The claim for post-judgment interest on repaid judgment monies was rejected; pre-judgment rate applied due to the nature of restitution upon a successful appeal.

Court Disposition

Notice of motion largely dismissed; orders for variation of costs and interest made as specified; no order as to costs of the notice of motion.
