The Plaintiff was an eligible person, but she had not been left without adequate provision for her proper maintenance because she received the whole estate other than the Pinaroo Place property, had her own assets and considerable earning capacity, and could practically reside in the Pinaroo Place property with the children. In any event, granting her the Pinaroo Place property absolutely would deprive the infant children of the only entitlement given to them by their father's will, and the Court was required to protect their competing interests.
