Because the County Court of Victoria had already referred to VCAT the issue whether the applicant needed a guardian or administrator or both, and that order and application stood unless and until disturbed on appeal, the Federal Court should take cognisance of that referral and, in the unusual circumstances of the case, stay the whole proceeding pending VCAT's hearing and determination of the matter.
