The psychology file recorded protected confidences, and Pt 36 r 13 applied notwithstanding that the documents were created before the rule commenced. However, in deciding whether production and inspection were prevented by Pt 36 r 13(2)(b), the Court could consider the s 126B(4) factors. There was no evidence of the nature or extent of harm that inspection by the plaintiffs' legal representatives would cause to Mr O'Donnell, some entries were potentially relevant and unavailable from the psychiatric reports, and the file had already been made available to the defendant. With undertakings not to copy or disclose the contents, production and inspection of the entire file were not prevented.
