Khatchadourian v GIO General Limited [2007] NSWDC 179
The plaintiff deliberately misrepresented his driving record to the Call Centre, knew the information was false, and intended GIO General Limited to act on it. He also failed to disclose relevant matters before the contract was entered into. The Court was satisfied that, had GIO General Limited known the true facts, both the Call Centre and Commercial division would have declined the risk. The fraudulent non-disclosure and misrepresentation entitled GIO General Limited to avoid the policy and refuse indemnity, and no basis was established to disregard that right under s 31.
