By majority, s 54 of the Seafarers Rehabilitation and Compensation Act 1992 (Cth), as applied to pre-24 June 1993 vested common law causes of action by s 13 of the Transitional Provisions Act, operated to acquire property by truncating accrued rights of action without affording just terms, thus rendering the legislation invalid in its application to such causes of action contrary to Constitution s 51(xxxi).
