The Tribunal committed errors of law by failing to apply the correct fund rules, substituting its own assessment for that prescribed in Rule 17, and not remitting the matter when rejecting the additional medical practitioner's opinion. The Trustee is required by Rule 17(d) to base its determination on the opinion of the appointed additional medical practitioner. Accordingly, the Trustee's original decision rejecting Mr Gilberg's TPD benefit claim is to be restored.
