Legal Issues
- 1 Whether the Tribunal erred in law by rejecting medical opinion and ignoring the governing rules of the Fund
- 2 Appropriate application of Rule 17 of the Fund rules in determining entitlement to Total and Permanent Disablement (TPD) benefit
- 3 Whether the Trustee is required to base its determination solely on the medical opinion of the additional medical practitioner under Rule 17(d)
Ratio Decidendi
The Tribunal committed errors of law by failing to apply the correct fund rules, substituting its own assessment for that prescribed in Rule 17, and not remitting the matter when rejecting the additional medical practitioner's opinion. The Trustee is required by Rule 17(d) to base its determination on the opinion of the appointed additional medical practitioner. Accordingly, the Trustee's original decision rejecting Mr Gilberg's TPD benefit claim is to be restored.
Court Disposition
Appeal allowed; Tribunal's determination set aside; Trustee's decision restored.
Orders
- Determination D05-06/132 of the Superannuation Complaints Tribunal is set aside.
- The Trustee's decision upon Mr John Gilberg's claim for a Total and Permanent Disablement Benefit is restored.
