Where a creditor bank receives payment in reduction of a customer debt by a third party acting under a mistake as to authority, the bank is not unjustly enriched as it simply exchanges a debt for cash; accordingly, no restitutionary claim lies against the bank in these circumstances—such a mistake may, however, support a claim for restitution against the party whose account was credited, not the bank.
