Orders dismissing an application for a noise abatement order and awarding costs are orders 'arising from' an application notice for the purposes of s 70(1)(b) of the Local Court Act 2007 (NSW); s 70(1)(b) confers jurisdiction on the District Court to hear appeals from such orders except where prohibited by the Act pursuant to which the orders were made, and in this case no such prohibition applied. The District Court's dismissal for lack of jurisdiction was a jurisdictional error.
