SZUQF v Minister for Immigration and Border Protection [2015] FCA 1409
The Minister's refusal letter dated 31 January 2014 was dispatched by post that day to the appellant's address for service and was deemed received on 11 February 2014. The 28-day period for applying to the Tribunal expired on 11 March 2014, but the appellant did not lodge his application until 8 May 2014. Because the application was outside the period required by s 412(1)(b) of the Migration Act, the Tribunal lacked jurisdiction and the Federal Circuit Court was correct to dismiss the judicial review application.
