SZWAY v Minister for Immigration and Border Protection [2018] FCA 268
The Refugee Review Tribunal overlooked important evidence that the appellant had given to the delegate, and some of its adverse credibility findings were made in the context of a mistaken understanding of what had previously been put by the appellant. That error was accepted by the Minister as jurisdictional error and was found by the Court to warrant orders, to be made in due course, allowing the appeal, setting aside the Federal Circuit Court orders, setting aside the Tribunal decision and remitting the matter to the Administrative Appeals Tribunal.
