The balance of convenience favours granting an interlocutory injunction to restrain Telstra from discontinuing telecommunications services to ComsWest, given the imminent expiry of the contract, disruption to the Western Australian Government, and ComsWest winding down its business. While the contract might permit Telstra's actions, there is a seriously arguable case to the contrary—including reasonableness requirements and lack of clear provision for security—which cannot be resolved at this stage. Injunction is conditional on ComsWest providing security for its undertaking as to damages.
