Because a large body of Dutch electronic material was missing, summaries or transcripts were available on the Netherlands National Police Agency BVO system, and communications between Dutch syndicate members and alleged coded language were important to the Crown case, there was potential for access to selected transcripts and Von Hohenberg call transcripts to materially assist the defence. Fairness did not require all missing material, but it did require a confined request. The interests of justice therefore required that the trial date be vacated and the accused's trial temporarily stayed until provision of the requested material or further order.
