The damage was not expected or intended by Fairview. AAI’s liability policies respond to Fairview’s potential liability for such property damage, and no exclusion clause operates to bar indemnity. Leave to proceed against the insurer is therefore granted, together with leave to amend the pleadings and joinder of AAI Limited.
