Procedural Posture
Application to Amend Summons and List Statement in Building Defects Proceedings / Interlocutory Application
Legal Issues
- 1 ['Whether the plaintiff should be granted leave to amend its summons and list statement to add further alleged mechanical ventilation defects after the expiry of a limitation period affecting potential cross-claims.' 'Whether the defendants would suffer prejudice because they could no longer bring viable cross-claims against Accent Ventilation Pty Ltd or Peter Rasa in respect of the further claims.' "Whether BIGC's involvement in related proceedings alleviated any prejudice suffered by the defendants." "Whether the plaintiff's particularisation of the alleged mechanical ventilation defects was inappropriate."]
Ratio Decidendi
Leave to amend was refused because the proposed mechanical ventilation claims were raised after the date by which the defendants could have brought building action cross-claims against relevant third parties, and the evidence showed those potential cross-claims were viable and realistic. The resulting prejudice was obvious and significant, was not adequately alleviated by BIGC's qualified involvement in related proceedings, and there was limited utility in permitting the same claims to be advanced against these defendants when they could not cross-claim to deflect liability.
