Although a claim for interest alone was open in equity as a claim for equitable compensation for alleged breach of trust, the alleged breach occurred on 1 May 1996 when the trustee rejected Mr Mann's claim, and the proceedings commenced on 2 June 2004 were outside the applicable six-year limitation period. The claim against the trustee was therefore statute-barred, and the claim against the insurer was dismissed because Mr Mann conceded he had no cause of action against it.
