Ratio Decidendi
The Court concluded the appropriate course is to allow restricted access (to counsel and solicitors for the Fund, subject to confidentiality undertakings) for all subpoenaed documents except: (1) those subject to legitimate claims of legal professional privilege, and (2) those which are confidential and wholly irrelevant to the proceedings. For these two exceptions, Air New Zealand must provide a schedule describing the documents. Masking is only permitted for privileged material, not for confidentiality alone.
