  1. 1 ['Was there a mistake at the time of entering the contract dated 13 April 2007?' 'Did Travelex have knowledge of the mistake?' 'Can the contract to purchase 60 million Japanese Yen be rectified?' 'Is the Plaintiff estopped from seeking to enforce the contract pursuant to representations made?']

Ratio Decidendi

Hamilford failed to prove on the balance of probabilities that Mr. Spriggs made a mistake when entering the 13 April 2007 contract or that Travelex strongly suspected any fundamental mistake. The signed confirmation and diary entry supported the existence and terms of the contract, and there was no evidence of conduct or representations by Travelex sufficient to found estoppel. Accordingly, there was no basis for rectification, rescission, or an estoppel preventing enforcement, and Travelex was entitled to judgment.
