TKD was not capable of managing his financial affairs because he had a traumatic brain injury, mild intellectual disability and long-term cognitive impairment, had relied on others for many years to assist with finances, had limited capacity for basic transactions, budgeting, bills and judgment, and remained vulnerable to exploitation. There was a need for someone to manage his affairs and it was in his best interests for an order to be made. As no private person was identified as willing and able to act, and the NSW Trustee and Guardian was supported by those at the hearing, management of TKD's estate was committed to the NSW Trustee and Guardian.
