Because Mr Flynn was the subject of a confirmed finding of professional misconduct in relation to work for another client of the Office of the Protective Commissioner, it was inappropriate for the Office to retain him where it needed confidence in agents assisting with estate management. Because Mr Krouk practised in Sydney and U could not have face-to-face appointments with him, he was also not appropriate. The correct and preferable decision was therefore to attempt to secure more localised, appropriate and skilled family law representation for U as an alternative to either firm.
