Procedural Posture

Class 1 Appeal Against Deemed Refusal of Development Application DA 13/1735 Under S 97(1)(b) of the Environmental Planning and Assessment Act 1979 / Final Judgment After Hearing

  1. 1 ["Whether the proposed rezoning of the site and council's plan to construct a drainage basin justified refusal of the development application on public interest grounds." 'Whether approval would unacceptably increase land acquisition costs for council.' 'Whether the proposal involved unacceptable tree loss.' 'Whether stormwater, drainage engineering and flooding impacts, including safe access and use of common open space, were acceptable subject to conditions.' 'Whether disputed drainage and modelling conditions should require approval by council or the Principal Certifying Authority.']

Ratio Decidendi

The appeal could not be dismissed on the basis that council might require the land for a drainage basin because Draft BLEP 2013 was neither imminent nor certain, acquisition was not shown to be immediate or urgent, no detailed implementation or funding steps had been established, and residential development would not necessarily preclude a drainage basin in some form. Subject to detailed conditions addressing drainage, flood warning, safe access, design amendments, landscaping and covenants, the development was acceptable under s 79C and consent could be granted.

Court Disposition

Appeal upheld; development application approved subject to conditions.
