The Commissioner did not err in law because he recognised that the DCP required egress to be to Wilson Parade only, recognised that the proposal departed from that standard by involving egress to the Princes Highway, and concluded that the departure was justified because it was suggested in the Road Safety Audit and would benefit the amenity of East Heathcote. That amounted to proper, genuine and realistic consideration of the DCP, so the council's appeal failed.
