Section 57(2) of the Safety, Rehabilitation and Compensation Act 1988 does not require or authorise an administrative character decision by Comcare. Suspension of compensation rights occurs automatically on the occurrence of the specified circumstances, and the existence of a reasonable excuse is a question of objective fact for a court to determine. Accordingly, the court has no jurisdiction under the ADJR Act to review such a 'decision'. However, the court does have jurisdiction to entertain an application for a declaration of right arising out of the same subject matter.
