The court held that the plaintiff had failed to prove the Contract for a Gift was an authentic document executed by the deceased and therefore failed to establish his claims. Even if the Macedonian Power of Attorney was authentic, the plaintiff failed to establish that he acted to his detriment in reasonable reliance on any representations in that document, and in any event, the power of attorney was procured by the undue influence and unconscionable conduct of the plaintiff. The proceedings were also brought as an abuse of process, but the claim was determined substantively on its lack of merit.
