The prosecutor was obliged to serve affidavits in support of the Class 5 summonses and breached the court rules by failing to do so. The prosecutor knew of the alleged offences in July 1998, delayed instituting proceedings until 24 December 1998, had not served supporting affidavits by the return date or by the stay motions, and filed no affidavit explaining the delay. The delay and failure to prepare the case over eleven months were inordinate, left the defendants in uncertainty, and caused prejudice including the loss of two potential vital witnesses. A permanent stay was therefore necessary, and the summonses were dismissed.
