The offence was objectively very serious, involving a considerable amount of heroin, bad antecedents, and commission while subject to a recognisance for a similar offence. The 25% discount for the early guilty plea was appropriate, and a 6 year head sentence was not manifestly outside the available sentencing range. Although there was material capable of constituting special circumstances, it was open to the sentencing judge to decline to alter the usual ratio, particularly given the applicant's antecedents and the view that he was as likely to be rehabilitated from heroin use in custody as by premature release.
